Plume is a manufacturer and distributor of electric or non-electric scooters and electric assistance bikes for consumers.

What is committed to Plume concerning my Product?

The characteristics of the Product, its mode of use and its price are communicated to me before the conclusion of the contract in the Product sheet on the website of Plume. These characteristics can evolve or change depending on technical developments.

In accordance with Article L112-1 of the Consumer Code, the consumer is informed, by means of marking, labelling, display or by any other appropriate process, of the particular prices and conditions of the sale before any conclusion of the sale contract. 

Contractual information is presented in detail and in French. The parties agree that the illustrations or photos of the products offered for sale do not have a contractual value. Except as special conditions, the rights granted under this contract shall be granted only to the natural person signatory to the order (or the person holding the email address provided).

NOTE: Trademarks, domain names, products, software, images, videos, texts or more generally any intellectual property rights information are and remain the exclusive property of PLUME. No transfer of intellectual property rights is carried out through these VGCs. Any total or partial reproduction, modification or use of such property for any reason is strictly prohibited.

The price of the Product is indicated in euros is mentioned all taxes included (VAT + any other taxes). The price appears clearly and precisely on the descriptive page of the Product; it does not include shipping and delivery charges. These fees are indicated to me during the information phase prior to the sale and at the time of confirmation of my order.

In any case, the total amount I have to pay is indicated on the order confirmation page. The sale price of the product is the one in force indicated on the order day. Plume reserves the possibility to modify its prices at any time but Plume guarantees the application of the price indicated at the time of my order.

In accordance with Article L.411-1 of the Consumer Code, the products and services offered for sale through these GTCs meet the existing requirements for the safety and health of persons, the loyalty of commercial transactions and the protection of consumers. Regardless of any commercial warranty, the Seller remains held in compliance defects and hidden defects of the product.

In accordance with Article L.217-4, the seller delivers a property in accordance with the contract and responds to existing compliance defects during delivery. It also responds to defects in conformity resulting from the packaging, assembly instructions or installation when the packaging was loaded by the contract or was carried out under its responsibility. In accordance with the legal provisions concerning compliance and hidden defects (art. 1641 (civ.), PLUME exchanges or reimburses products defective or not corresponding to the order. Reimbursement may be requested by mail or by mail from PLUME, which will proceed to the exchange or resumption of the Product.

Plume undertakes to honour your order, but within the limits of its available stocks only. If, following my order, my Product is unavailable for a period of more than one month (30 working days), Plume undertakes to notify me immediately and to provide me with a new predictable delivery date.

If I do not agree on a new delivery date within one month, I can cancel my order on request from the customer Plume. For the return of the price, I then have the choice to ask either an asset for a subsequent order or the full refund of the amount of my order.

When the product is not delivered immediately, clear information is provided to the Customer on the delivery dates. By accepting these CGVs, the Customer certifies that he has received a detail of the shipping costs and the terms and conditions of payment, delivery and execution of the contract, as well as detailed information on the identity of PLUME, its postal, telephone and electronic contact information, and its activities in the context of this sale.

Plume undertakes to deliver the Product to the address that I have entered during my order in Metropolitan France. Plume does not take into account the logistic preparation time or the transport hazards falling under the carrier's responsibility. If I order several products at the same time, these may have different delivery times and modes.


In the event of delay in delivery, the Customer has the option to resolve the contract under the terms and conditions set out in Article L.138-2 of the Consumer Code. PLUME then reimburses the product and costs “go” under the terms of Article L.138-3 of the Consumer Code. PLUME provides a telephone contact point (cost of a local communication from a fixed station) indicated in the order confirmation email to ensure the monitoring of the order. PLUME recalls that when the Customer physically takes possession of the Product, he becomes responsible for the risks of loss or damage that could affect it. It is the responsibility of the Customer to notify the carrier of all the reserves on the Product with transport-related damage.

Plume undertakes to give me a Product that complies with the applicable standards and meets the safety requirements of the law. In the event that the Product presents, despite the quality control performed, a lack of conformity or a hidden defects, Plume exchange me or refund the product not corresponding to my order. However, to promote the repair and sustainability of its Products, Plume priority will be to re-conform or repair prior to any exchange or refund of the Product.

How my Product is guaranteed Plume ?

The guarantees provided by law, namely the guarantee of conformity and the guarantee of hidden defects:

- For defects in conformity of my existing product on the date of acquisition, I have a period of 2 years from the date of delivery to act with Plume to request under warranty the delivery, repair or replacement of the Product. To promote the repair and sustainability of its Products, Plume will first perform the repair before any exchange of the Product.

In case of repair of my product, I get a 6-month warranty extensions.

For hidden defects, i.e. defects making my product unfit for its use and appeared after the date of acquisition, I am 2 years from the appearance of the vice to act with Plume to request either a reduction in the selling price or the resolution of the sale. Plume reserves the possibility of proposing an alternative solution, in order to promote the repair and sustainability of its Products, to regain the use of my Product.

 

Plume offers a 3-year warranty extension (commercial warranty) on the chassis subject to activation of the lifebook.

This activation is to be carried out directly via the application Plume or on the website Plume.

Plume undertakes to inform me of the additional contractual guarantees concerning the Product I bought.

In accordance with the law, PLUME assumes the guarantee of compliance and the guarantee for hidden defects of products:

Compliance Guarantee: PLUME refunds or exchanges products that are apparently defective or not corresponding to the order made. The Customer must send his refund request by mail or by mail to the PLUME Company address; it may choose between the repair or replacement of the property subject to the conditions provided for in the above-mentioned provisions. In the event of a failure to comply with the delivered property, the Customer is exempt from providing proof of the existence of this failure to comply with the property within six months of the issuance of the property.

Guarantee of hidden defects: When the Product is affected by a vice making it unfit for its use within the meaning of article 1641 of the Civil Code, the Customer may choose between the resolution of the sale or a reduction of the selling price (Articles 1644 and s. of the Civil Code).

- If I have altered or altered the specificities of the Product in such a way that it no longer meets the original specifications, in particular during a repair not conforming to the preconizations given by Plume ; 

- If I have not complied with the mandatory safety instructions concerning the battery of my Product (no ban on opening and dismantling the battery);

- If I do not comply with the assembly instructions of my Product that are provided in the instructions for use;

-When I ask for the replacement of consumable parts (non-structural element likely to wear due to normal use) namely: tires, wheels, air chambers, bearings, brakes, cables and sheaths, grip of the tray, handles, led lights, battery cells;

- When I request repair of aesthetic defects related to normal wear when using the Product;

- When I ask for repair for wear or breaks due to use in conditions not in conformity with the product's destination, including by skatepark, in all terrain, in acrobatic use, transport of heavy loads or several people, or when immersion of the product, even partial;

- When I do not comply with the maintenance instructions of my Product in the user notice;

- When I request repair of defects from the use of spare parts or accessories not approved by Plume (including the charger);

- When no product failure was found Plume ; 

- When my product is damaged as a result of an accidental break (lap, shock...). You can make sure for this risk from our OWEN Partner;

- When I cannot prove the purchase of my Product by an invoice or by the lifebook that I activated online and that I hold;

NOTE: The occurrence of a fortuitous or force majeure case (natural catastrophe, pandemic, strikes, etc.) preventing the execution of the contract has the effect of clearing Plume any liability for the non-performance of its obligations. If such a case occurred, Plume undertakes to warn me as soon as possible.

I can maintain or repair my product myself Plume thanks to the tools available in the Space Support accessible from the site Plume. I can find all the necessary advice and help to repair and maintain my Product.

However, if I wish to maintain or repair my product Plume by a professional, i have to address one of the resellers - repairers approved by Plume.

I can find the address of the repairer closest to me on the website Plume.

What do I commit to as Client Plume ?

To pass my order online, I must create my Personal Space on the website Plume. 

Procedure for creation

To create your Personal Space, you must go to the site Plume and complete the required fields of the registration form, knowing that you can only create one profile for your personal account.

This account is strictly personal and you are the only person responsible for the accuracy of the information you have entered in the form.

Management of your identifiers

You must choose your logins and password. They are strictly personal to you and must not be disclosed to third parties.

Activation of your Personal Space

By validating the creation of your Personal Space, you acknowledge that you have been able to verify and modify, if necessary, the information you have provided. You guarantee that you have provided accurate and complete information regarding your identity and contact information.

Update of your information

You undertake to regularly update all of your Personal Space information in order to preserve its accuracy and allow it to Plume ensure continuity of your customer follow-up.

Payment of the price must be made to the order, including for pre-order products.

I can make the payment by payment card via French and European domestic and business cards. Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa).
I can also benefit from a payment in 3x or 4x free of charge, offered by FRANFINANCE, the Loaner (719 807 406 R.C.S Nanterre – N°Orias 07 008 346). See terms of the offer.

The product I bought remains the property of Plume until the full payment of the price.

In accordance with the provisions of the Monetary and Financial Code, the commitment to pay by card is irrevocable. By communicating its bank information during the sale, the Customer authorizes PLUME to debit its account or card from the amount relative to the price indicated. By accepting these GTCs, the Customer confirms that he is the legal holder of the account or card to be debited and that he is legally entitled to make use of it. In case of error, or impossibility to debit the card, the sale is immediately resolute in full right and the order cancelled.

How can I act in case of dissatisfaction?

The law gives me the right to withdraw, without cause, within 14 days from the date of receipt of my order. I can exercise this right by contacting Plume by mail, by telephone or by mail, according to the coordinates indicated on the invoice. I will also find a typical letter of withdrawal to download from the PLUME website. This letter is to be sent to us as recommended with acknowledgement of receipt.


The price of the Product and its shipping costs will be refunded within 30 days of receipt by Plume of the product following my request for withdrawal. However, the return costs remain at my expense. I have to return the Product in its original and complete state (packing, accessories, notice) and with a copy of the proof of purchase.


Upon receipt of the product, Plume verify the condition of the product and its accessories. The possible rehabilitation of the product and/or supply of missing accessories will be charged and deducted from the refund.

In accordance with the Consumer Code (Article L-224-59), no right of retraction is recognized to the buyer for purchases made during a trade show or fair.

I can send all my claims to customer service Plume by means of the coordinates indicated on the website, on the order or delivery order form. The customer service will process my request as soon as possible.

In the event of failure of my claim or in the absence of a response within 2 months, I may refer to a consumer mediator under the conditions prescribed by law (Book VI of the Consumer Code). This ombudsman will try independently to bring my perspective closer to that of Plume for a friendly solution to my claim.

I can request the cancellation of my order and the resolution of the sale contract by registered letter with request for a notice of receipt addressed to Plume in the following cases:

- The product delivered does not conform to the characteristics of the order;

- The price has risen or the Product has been modified. If I paid a deposit, I can ask for his refund here.

How Plume does she protect my personal data?

In accordance with the law (Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free flow of such data), Plume has put in place a processing of my personal data that has for the purpose the sale and delivery of the product I bought.

 

The information that was requested to me at the time of the order is those strictly necessary for the establishment of the invoice and delivery of the ordered property. They allow Plume to deliver targeted information and advertising, to operate payment and delivery services, to monitor the maintenance and repair of my products.

 

I have the right to ask Plume access to my personal data, rectification or deletion of them; i can request a limitation of the processing, oppose the processing, or benefit from the right to the portability of my data. If I cannot exercise these rights, I can file a claim with a supervisory authority.

 

PLUME informs the Customer that he is responsible for processing his personal data and that the legal basis for processing is the execution of the sales contract. The recipients of this data are exclusively the service in charge of the sale, order and delivery, any subcontractors involved in the sale or delivery operations, the marketing and communication service, the maintenance and repair service of the products, and any authority legally authorized to access your personal data. The data will be retained during the time of commercial prescription, five years. No transfer of your data outside the EU is planned or authorized.

What are the VGCs for?

General Terms and Conditions of Sale determine the rights and obligations of the Customer and Plume as part of the online sale of its products. They also provide you with full information on the terms and conditions of the sale, including payment of the price, delivery, guarantees, claims.

When I purchase, I accept these VGs before placing an order by checking the "Acceptation of VGs" box and I acknowledge that they have now applied and enforceable.

Thus by checking this box:

- I declare that I have become aware of and, where appropriate, of the specific sales conditions related to a product or service;

- I accept clearly and unconditionally that I consent to the application of the VGCs to the sales contract;

- I acknowledge that I have benefited from all the information necessary to engage in the sales contract.

Plume reserves the possibility to modify and improve its VGCs at any time by publishing a new version on its website. However, the GTCs applicable to the contract remain those validated at the time of my order.
